1. What Biashara Hub Is

Biashara Hub is a marketplace platform that connects independent businesses, service providers, and delivery riders with customers. We do not manufacture, own, or directly sell the products or services listed on the platform - each business is independently responsible for what they list, the accuracy of their listings, and fulfilling orders and bookings placed with them.

2. Orders, Bookings & Payments

Orders and bookings are agreements between the customer and the individual business, not with Biashara Hub directly. Payment methods, delivery arrangements, and pricing are set by each business. Biashara Hub facilitates discovery and, where applicable, subscription payments from businesses and riders via M-Pesa, but is not a party to transactions between customers and businesses.

3. Prohibited & Restricted Items

Businesses are solely responsible for ensuring their listings comply with Kenyan law and are placed under the correct, accurate category. The following are strictly prohibited on Biashara Hub, regardless of category:

Adult products (18+) are permitted only under categories explicitly designated as adult-only, and must never be listed under a general or unrelated category. Businesses that misclassify a listing to bypass this requirement are in violation of these terms.

Biashara Hub reserves the right to remove any listing, and suspend or permanently remove any business or rider account, that violates this section - with or without prior notice.

4. Business & Rider Accounts

Businesses and riders are responsible for the accuracy of their listings, pricing, and availability. Biashara Hub reserves the right to verify, feature, suspend, or remove any account or listing that violates these terms or is found to be fraudulent, misleading, or harmful to other users.

5. Disputes

Disputes about an order, booking, or a business's conduct should first be raised directly with that business. If unresolved, you can reach us through our Support page and we will do our best to help mediate, though we cannot guarantee a specific outcome for disputes between independent parties.

6. Changes to These Terms

We may update these terms from time to time as the platform grows. Continued use of Biashara Hub after changes are posted means you accept the updated terms.

7. Platform Availability

Biashara Hub aims to keep the platform available and functioning properly, but we do not guarantee that the platform will always be available, uninterrupted, secure, or free from errors. We may temporarily suspend, modify, or restrict access to all or part of the platform for maintenance, security, updates, improvements, or other operational reasons.

8. Listing Accuracy & User Responsibility

Businesses and riders are responsible for ensuring that the information they provide on Biashara Hub is accurate, complete, and up to date. This includes business information, product and service descriptions, prices, availability, images, contact information, delivery information, and other information presented to customers.

Users must not use Biashara Hub to impersonate another person or business, provide fraudulent or misleading information, manipulate reviews or ratings, or use the platform for activities that violate applicable Kenyan law or these terms.

9. Platform Content & Intellectual Property

Businesses and other users may upload or provide content such as business names, logos, photographs, product descriptions, service descriptions, and other materials to Biashara Hub. Users are responsible for ensuring that they have the necessary rights or permission to use content they upload.

By submitting content to Biashara Hub, you grant us permission to use, display, reproduce, and distribute that content as reasonably necessary to operate, promote, and improve the platform. This permission does not transfer ownership of the user's intellectual property to Biashara Hub.

10. Third-Party Services & Links

Biashara Hub may use or provide access to third-party services, payment providers, communication services, mapping services, hosting providers, or other external services. Third-party services may have their own terms and privacy policies, and Biashara Hub is not responsible for the independent operation, availability, or policies of third-party services.

11. Limitation of Responsibility

Biashara Hub provides a platform for discovering and connecting with independent businesses, service providers, riders, and customers. To the extent permitted by applicable law, Biashara Hub is not responsible for losses, damages, delays, injuries, defective products, poor-quality services, inaccurate listings, failed deliveries, cancellations, or other issues arising from transactions between independent users.

Nothing in these terms is intended to exclude or limit any responsibility or liability that cannot legally be excluded or limited under applicable Kenyan law.

12. Account Suspension & Termination

Biashara Hub may suspend, restrict, or terminate an account where we reasonably believe that the user has violated these terms, applicable law, engaged in fraudulent or harmful activity, provided false information, or created a risk to the platform or other users.

Users may stop using Biashara Hub at any time. Termination or suspension of an account does not remove obligations or responsibilities that arose before the account was suspended or terminated.

13. Governing Law

These terms are governed by and interpreted in accordance with the laws of Kenya. Any disputes concerning these terms will be handled in accordance with applicable Kenyan law and the jurisdiction of the relevant Kenyan courts, subject to any rights or remedies that cannot legally be excluded.
